TERMS AND CONDITIONS (T&Cs)

§ 1 General Provisions

For the business relationship between the platform Glambou operated by Glambou Retail AG, Limmatquai 48, 8001 Zurich, Switzerland (hereinafter referred to as "Glambou", "we" or "us") and the customer ordering in the online shop, the following Terms and Conditions apply exclusively in the version valid at the time of the order. Please read the Terms and Conditions carefully before placing an order in our online shop. We recommend that you make a copy of the Terms and Conditions.

The supply in the online shop is exclusively available for consumers with residence and delivery address in Switzerland.

We only accept orders from customers who have reached the age of 18 at the time of the order.

All correspondence regarding these Terms and Conditions is handled by Glambou Retail AG, Marktgasse 9, 8001 Zurich, Switzerland at contact@glambou.com.

 

SECTION A – CURRENT SALES PROMOTIONS

All orders for products made in relation to the promotions described in section A are governed by the Terms and Conditions as well as by the general sales conditions as stated in § 4 Orders and Returns below.

  

Promotion: “Newsletter”

After successfully signing up for our newsletter, you will receive a 10% voucher code from us via e-mail, which you can redeem for your first order with a purchase value of more than CHF 75. This code can only be redeemed once, cannot be combined with other offers and / or codes and does not apply to items from our marketplace partners. Glambou reserves the right to change or withdraw this offer at any time.

 

Promotion: “15% discount on your first order over 75 CHF”

During certain promotional periods, we will give you a 15% discount on your first order over 75 CHF. This code can only be redeemed once, cannot be combined with other offers and / or codes and does not apply to items from our marketplace partners. Glambou reserves the right to change or withdraw this offer at any time.

 

Promotion: "40 CHF Jewelry Credit"

The promotion is part of a goodie bag promotion and is limited in time. The voucher can be redeemed once per person with a minimum order value of CHF 120 online or in one of our stores. The voucher is not valid on sale and marketplace products and cannot be combined with other promotions. A payout of the voucher is not possible. Glambou reserves the right to change the conditions of the promotion at any time or to withdraw the offer.

 

Promotion: "Mother’s Day: Gift with Purchase" 

The promotion is valid from 26.04.2024 to 12.05.2024 and only while stocks last. To receive the gift, a minimum order value of CHF 150,- is required and the product must be added to the shopping basket. Reduced products are excluded from the promotion. Only one gift can be redeemed per order. A combination with other discounts or promotions as well as a payout of the gift is not possible. Glambou reserves the right to change the conditions of the promotion at any time or to withdraw the offers.

  

§ 2 Payment Authorization

To be able to make payments in the online shop, you must enter your personal details. It is essential that you provide your correct name, phone number, e-mail address and other required information. In addition, when you order the products, you will be asked to provide the payment information correctly and to ensure that it is correct and valid. You confirm that you are the person stated in the billing information.

If you are paying by credit card, you must provide a valid credit card from a Glambou-approved bank and you must have authorized Glambou to charge your credit card for the purchase amount of the products purchased.

In case Glambou deems it necessary, information about you will be transmitted or obtained by third parties. These may include information about your credit card number or credit information to confirm your identity, to validate your credit card, to obtain a first credit card authorisation, and to authorize your individual payment transactions.

Your personal information provided may be forwarded to one of our payment processing partners, a credit or fraud prevention agency, which may then keep a record of that information.

You consent to receiving invoices and credits solely in electronic form.

 

§ 3 Terms of Use

You agree not to use Glambou: 

  • in a manner capable of interrupting, damaging or otherwise impairing access to Glambou, or
  • for fraudulent purposes or in connection with a criminal offense or illegal activity.

 

In addition, each user is required to refrain from posting content or submitting messages that 

  • are immoral, pornographic, racist or offensive in any other way,
  • are untrue or deliberately untrue, 
  • violate the rights of third parties, in particular, copyrights,
  • violate applicable laws or comply with a criminal offense in any other way, 
  • contain viruses or other computer programs that could damage software or hardware or interfere with the use of computers,
  • are surveys or chain letters or stealth advertisements or 
  • serve the purpose of collecting and/or use personal data of other users for business purposes.

 

Glambou reserves the right to prohibit access to and use of the site, close user accounts (member accounts), or remove or modify content if it violates any applicable law, these terms of use or any other applicable Terms and Conditions or policies. Furthermore, Glambou can delete published comments and contributions posted on social networks (Facebook, Twitter, LinkedIn, Instagram, etc.) without stating reasons and without notice at any time. When reviewing orders, only truthful, factual information may be provided that does not contain any defamatory content. 


§ 4 Orders and Returns

ORDERS

Our website and our online shop are merely an invitation to the customer to submit offers for the conclusion of a purchase agreement for the presented products. All orders are subject to availability and our acceptance.

Glambou offers products that are ready to be shipped from our warehouse. Occasionally, due to production issues or quality controls, we may be unable to deliver some products at the time of your order. If this happens, we will contact you immediately via e-mail and refund the originally debited amount to your credit card within 30 days of confirmation of the non-deliverable product.

PRICES

The prices listed on the website are indicated in the currency displayed. Unless otherwise indicated, the price includes VAT.

CONFIRMATION OF YOUR ORDER

As soon as you have selected your product via the "add to cart" button and submitted your order, this forms a binding offer for the purchase of the products in the shopping cart.

You will then receive an email with the order confirmation. This email is NOT an order acceptance but only a confirmation of the receipt of your order.

The order acceptance and the conclusion of the contract between you and Glambou shall be deemed to have taken place as soon as we send you an Email with the order confirmation. The sales contract is concluded in Zurich (Switzerland) and the language of the contract is German.

We reserve the right to refuse the order at our discretion. We are not liable to you or third parties due to our cancellation. In particular, we cannot accept the order for the following reasons: (1) In the event of non-authorization of payment; (2) in the case of a product which is not in stock or does not meet our quality control standards and must therefore be withdrawn; (3) You do not fulfil the criteria defined in these Terms and Conditions.

SHIPPING INFORMATION

All shipments are carried out by Swiss Post. They cannot be delivered to PO boxes or PickPost stations. The general Terms and Conditions of Swiss Post AG apply additionally and may be accessed at: www.swisspost.ch

SHIPMENT TRACKING

Once we have sent out your order, you will receive a notification via email including the post tracking number. You can check the shipment status after one to two hours at www.swisspost.ch. Enter your tracking number to track the status of your shipment.

DELIVERY TIME

Estimated delivery times for Switzerland: 48 hours

The estimated delivery times should be regarded as a guideline and start on the date of dispatch. We assume no liability for delivery delays.

The passing of risk begins with the time of the product arrival.

SHIPPING COSTS

Shipping costs are taken over by Glambou and free shipping applies to all purchases regardless of a minimum order value.

 

PAYMENT METHODS

We only accept the payment methods displayed to the customer during the order process.

If you pay by credit card, the amount will be debited after your order has been shipped by Glambou. You confirm with the payment that the used credit card belongs to you or that you have a specific authorisation from the owner. All credit and debit card holders are subject to validation and authorisation of the card issuer. Should the issuer of your payment card refuse payment to Glambou, we will not be liable for any delays or non-delivery of the product.

Purchase on account with instalment option (POWERPAY):

MF Group/POWERPAY offers the payment method "purchase on account" as an external payment service provider. With the order account, you can easily pay your online purchase by invoice. If you do not make a payment in the given timeframe, you will receive a payment reminder with additional late fees.

At the conclusion of the purchase contract, POWERPAY accepts the invoice claim and processes the corresponding payment modalities. When purchasing on account you accept in addition to our Terms and Conditions, the Terms and Conditions of POWERPAY. (powerpay.ch/de/agb).

We make every effort to make our website as safe as possible. All credit card transactions are handled by DataTrans, an online payment gateway that encrypts your card details in a secure database environment. If you are a registered user, we will keep your credit card details securely in our system. These details are completely encrypted and will only be used for your card transactions.

 

RETURNS

For all orders placed between 25.11. and 21.12.2023, an extended right of return applies until 31.01.2024.

As a rule, returns are only possible 14 days (calendar days) after receipt of the items. The date of the postmark or the delivery of the collection invitation is decisive. After this period, a return is no longer possible. We recommend that you check the item right after receipt and, if desired, send it back immediately. The following conditions also apply: (1) The item is undamaged and unworn, (2) The item is in undamaged original packaging, (3) All original labels are still present and as received fixed, (4) Any accessories supplied are returned with the item

If all these conditions apply, we will refund you the purchase price paid.

Alternatively, you can also return your items in a Glambou or Pompidou store for free. Please note that also in this case the return slip is mandatory.

In general, the shipping costs for the return of unwanted items are to be paid by the purchaser or sender. If any of the following conditions apply, shipping costs will be paid by Glambou: (1) item is not in accordance with the order, (2) incorrect information on Glambou, (3) defective item received, (4) incomplete product

The items must be packed safely by the customer for return. The return of an item must be in original packaging, complete and with all accessories.

FAULTY PRODUCTS/INCORRECT DELIVERIES

Please check the received products for errors immediately after receipt. Products are faulty if they arrive damaged or have a material or manufacturer error. Customary or technically unavoidable, material-related deviations of the quality, colour, size, or the design of the product are no defects. This also applies to natural wear.

PRODUCT EXCHANGE

We offer no right of exchange. However, you can make use of the right of return (see chapter "Returns").

§ 5 Colours

We strive to reproduce the colours of the products on our website as accurately as possible. However, computer screens may have different image resolutions. Therefore, we cannot guarantee that your screen resolution will accurately reflect all colours.

§ 6 Data Processing

We will only process personal information in accordance with our applicable privacy policy.

§ 7 Changes to the Terms and Conditions

Glambou reserves the right to change these Terms and Conditions at any time without notice. The customer is subject to the Terms and Conditions in effect at the time the customer starts using Glambou. 

Within the scope of the order process, the customer only agrees to Glambou’s Terms and Conditions and the Terms and Conditions of the respective shops mentioned in the order process. Other conditions are not applicable.

§ 8 Integration of the Trusted Shops Trustbadge / other widgets

Our website has integrated Trusted Shops widgets to display Trusted Shops services (e.g. seal of approval, collected reviews) and to offer Trusted Shops products to buyers after an order.

This serves to safeguard our overriding legitimate interests in optimal marketing by enabling secure shopping in accordance with Article 6 Paragraph 1 Sentence 1 lit. f GDPR. The Trustbadge and the services advertised with it are an offer from Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne, with whom we are jointly responsible under Art. 26 GDPR. In the context of this data protection notice, we will inform you below about the essential contents of the contract in accordance with Art. 26 (2) GDPR.

The Trustbadge is provided by a US CDN provider (Content Delivery Network) as part of a shared responsibility. An appropriate level of data protection is ensured by standard data protection clauses and other contractual measures. Further information on data protection at Trusted Shops GmbH can be found in their data protection declaration.

When the Trustbadge is called up, the web server automatically saves a so-called server log file, which also contains your IP address, date and time of the call, amount of data transferred and the requesting provider (access data) and documents the call. The IP address is anonymized immediately after collection, so that the stored data cannot be assigned to you personally. The anonymized data is used in particular for statistical purposes and for error analysis.

After completing the order, your hashed e-mail address will be sent to Trusted Shops GmbH using a one-way cryptographic function. The legal basis is Article 6 Paragraph 1 Clause 1 Letter f GDPR. This serves to check whether you are already registered for services with Trusted Shops GmbH and is therefore necessary for the fulfillment of our and Trusted Shops' overriding legitimate interests in the provision of buyer protection linked to the specific order and the transactional evaluation services in accordance with Art. 6 paragraph 1 sentence 1 lit. f GDPR. If this is the case, further processing takes place in accordance with the contractual agreement made between you and Trusted Shops. If you are not yet registered for the services, you will then be given the opportunity to do so for the first time. Further processing after registration is also based on the contractual agreement with Trusted Shops GmbH. If you do not register, all transmitted data will be automatically deleted by Trusted Shops GmbH and a personal reference is then no longer possible.

Trusted Shops uses service providers in the areas of hosting, monitoring and logging. The legal basis is Article 6 Paragraph 1 Letter f GDPR for the purpose of ensuring trouble-free operation. Processing can take place in third countries (USA and Israel). An appropriate level of data protection is ensured in the case of the USA by standard data protection clauses and other contractual measures, and in the case of Israel by an adequacy decision.

As part of the joint responsibility between us and Trusted Shops GmbH, please contact Trusted Shops GmbH using the contact options given in the data protection information linked above if you have any questions about data protection and to assert your rights. Irrespective of this, you can always contact the responsible person of your choice. If necessary, your request will then be forwarded to the other person responsible for an answer.

§ 9 No Waiver

Should the customer violate these T&Cs and Glambou does not intervene, this does not constitute a waiver of Glambou's rights. Glambou shall also be entitled to exercise its rights on any other occasion on which you violate these Terms and Conditions.

§ 10 Applicable Law and Jurisdiction

Swiss law applies, excluding the UN Sales Convention (CISG). The exclusive place of jurisdiction, subject to any legally binding jurisdiction, is Zurich, Switzerland.

Failing to comply with these Terms and Conditions (including the Privacy Policy) may result in loss of membership and access to Glambou.
